Overview
These Terms of Service (the "Terms") govern your access to and use of
ekkos, including any related websites, web applications, mobile or
progressive web apps, and services (collectively, the "Service").
By accessing or using the Service in any way, you agree to be bound by
these Terms. If you do not agree to these Terms, you may not use the
Service.
ekkos is currently offered in an MVP / early access state and is provided
for testing, feedback, and non-commercial personal use. Features may
change, break, or be removed at any time.
Eligibility and Accounts
You may use the Service only if you are capable of forming a binding
contract with us under applicable law. By using the Service, you
represent and warrant that:

You are at least 18 years old (or the minimum age of digital consent in
your jurisdiction, if higher), and

You are not barred from using the Service under any applicable laws.
You may be required to sign in using a third-party identity provider
(such as Google, Apple, or Outlook) to use certain features. You are
responsible for maintaining the confidentiality of your credentials and
for all activity that occurs under your account.
Description of the Service
ekkos is an AI-assisted task and reminder scheduling service designed to
help you set up and manage reminders using natural language. You can
submit prompts such as "Remind me to walk my dog every morning"
or "Help me stretch three times a week," and the Service attempts to:

Interpret your request using machine learning and large language model
(LLM) techniques,

Generate a schedule or recurring reminder pattern, and
-
Deliver notifications or in-app activity around your tasks.
The Service may display an activity history of your tasks, including
actions such as creation, pause, resume, completion, and deferral. This
information is provided for your convenience and may not always be
complete or error-free.
Early Access and No Service Level Commitments
The Service is currently in an MVP / experimental phase and is provided
without any uptime guarantees, service level agreements, or
feature guarantees. Features may be modified, limited, or discontinued,
temporarily or permanently, without notice.
You acknowledge that the Service may contain bugs, experience failures,
lose data, or deliver inaccurate or delayed reminders. You should not
rely on ekkos as the sole system for critical or safety-related tasks.
No Emergency or Life-Critical Use
The Service is not designed or intended for use in situations where
failure, delay, or inaccuracy could lead to death, personal injury,
or serious harm, including but not limited to:

Emergency response or life support,

Time-critical medical treatments or medication adherence where missing
a dose could cause serious harm, or
-
Any other high-risk or safety-critical context.
You remain solely responsible for managing your own tasks, including
medical, financial, and professional responsibilities, and for having
redundant or more reliable systems in place where appropriate.
AI-Generated Content and No Professional Advice
The Service may generate suggestions, descriptions, or other content
using AI models based on your inputs and other data. AI-generated
outputs may be incomplete, inappropriate, or incorrect, and can change
over time as models and prompts are updated.
AI-generated content provided through the Service is for informational
and organizational purposes only and does not constitute medical,
mental health, legal, financial, or any other professional advice.
You should not rely on the Service as a substitute for professional
judgment and should always consult qualified professionals for
questions involving those domains.
Privacy and Data
Our collection and use of personal data in connection with the Service
are described in our
Privacy Policy.
By using the Service, you acknowledge that your personal information
will be handled in accordance with that policy.
To operate, maintain, and improve the Service, we may process your
input text, task details, interaction history, and technical data
(such as device, browser, and usage information). We may also use
aggregated or de-identified data for analytics and to improve the
Service over time.
Your Content and License to Us
You may provide content to the Service, including text prompts, task
descriptions, labels, and other information ("User Content").
You retain ownership of your User Content.
By submitting User Content to or through the Service, you grant us a
non-exclusive, worldwide, royalty-free, sublicensable license to use,
host, store, reproduce, modify, and create derivative works from your
User Content as necessary to:

Maintain and improve features and functionality, and

Comply with applicable laws and enforce these Terms.
You are responsible for ensuring that your User Content and your use
of the Service comply with all applicable laws and these Terms.
Acceptable Use
You agree not to misuse the Service. Without limiting the generality
of the foregoing, you agree not to:

Use the Service in any manner that violates any law or regulation;

Attempt to gain unauthorized access to any systems or networks;

Interfere with or disrupt the integrity or performance of the
Service or related systems;

Reverse engineer, decompile, or attempt to derive the source code
of the Service, except as permitted by law;

Use the Service to send spam or other unsolicited communications;

Upload or transmit any viruses, malware, or other harmful code;

Misrepresent your identity or affiliation with any person or entity.
Intellectual Property
The Service, including all software, text, graphics, logos, and other
content (excluding your User Content), is owned by us or our licensors
and is protected by copyright, trademark, and other laws.
Subject to your compliance with these Terms, we grant you a limited,
non-exclusive, non-transferable, revocable license to access and use
the Service for your personal, non-commercial purposes.
We reserve all rights not expressly granted in these Terms.
Third-Party Services and Links
The Service may integrate with or rely on third-party services,
such as identity providers, analytics tools, or notification
providers. Your use of those third-party services may be subject
to separate terms and privacy policies, which you are responsible
for reviewing.
We are not responsible for, and do not endorse, third-party
services, websites, or content, and we will not be liable for
any damages arising out of or in connection with your use of
third-party services.
Fees and Changes to the Service
At this time, ekkos is offered without charge as part of an MVP /
early access program. We reserve the right to introduce paid
features, subscription plans, or usage-based limits in the future.
If we introduce fees for some or all of the Service, we will
take reasonable steps to notify you in advance and may ask you
to agree to additional or updated terms. Your continued use of
the Service after changes become effective will constitute your
acceptance of those changes.
Suspension and Termination
You may stop using the Service at any time. You can delete your
tasks or other data where functionality allows, but we may retain
certain information as described in our Privacy Policy and as
required by law.
We may suspend or terminate your access to the Service, with or without
notice, if we believe that:

You have violated these Terms or applicable law, or
-
Your use of the Service creates risk or possible legal exposure
for us or other users.
Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
To the fullest extent permitted by law, we disclaim all warranties
of any kind, whether express, implied, or statutory, including but
not limited to implied warranties of merchantability, fitness for a
particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, timely,
secure, or error-free, or that any defects will be corrected.
We make no guarantees about the accuracy, completeness, or
usefulness of any information, reminders, or AI-generated content
provided through the Service.
Limitation of Liability
To the fullest extent permitted by law, in no event will we be
liable for any indirect, incidental, special, consequential, or
punitive damages, or any loss of profits or revenues, whether
incurred directly or indirectly, or any loss of data, use, or
goodwill, resulting from:

Your access to or use of, or inability to access or use, the
Service;

Any conduct or content of any third party on the Service;

Any content obtained from the Service; or
-
Unauthorized access, use, or alteration of your transmissions
or content.
To the fullest extent permitted by law, our total liability for any claims arising out of or relating to the Service or these Terms will be limited to the amount you paid us, if any, for use of the Service in the 3 months preceding the event giving rise to the claim.
Indemnification
To the extent permitted by law, you agree to indemnify, defend, and
hold harmless us and our affiliates, and our respective officers,
directors, employees, and agents, from and against any claims,
liabilities, damages, losses, and expenses (including reasonable
attorney fees) arising out of or in any way connected with:

Your access to or use of the Service;

Your User Content; or
-
Your violation of these Terms or any applicable law.
Changes to These Terms
We may update these Terms from time to time. When we do, we will
revise the "Last updated" date at the top of this page.
In some cases, we may provide additional notice (such as a banner
or in-app notification).
Your continued use of the Service after the updated Terms have
become effective will constitute your acceptance of the changes.
If you do not agree to the updated Terms, you must stop using
the Service.
Governing Law and Venue
These Terms and any dispute arising out of or relating to them or
the Service will be governed by the laws of the State of Minnesota,
United States, without regard to its conflict of laws principles.
You agree that the exclusive jurisdiction and venue for any legal
action or proceeding arising out of or relating to these Terms or
the Service will be the state or federal courts located in
Minnesota, and you consent to the personal jurisdiction of those
courts.
